First, I state what series and music I use in the description so it can clearly be seen. I know some AMV creators are terrified of this creating a tag in their work and making it get taken down. From experience, having a tag on something is usually not why it gets taken down from youtube. I like to make sure that people know whom I’m giving credit to, and I think often, creators respect that I do that.
The second thing I do is add these two paragraphs into every video:
“Copyright Disclaimer Under Section 107 of the Copyright Act 1976, allowance is made for "fair use" for purposes such as criticism, comment, news reporting, teaching, scholarship, and research. Know that, under the current law AMVs are loosely covered under the Fair Use clause in the United States Copyright Act. Unless you are uploading an entire episode of content or an original scene without commentary, you are pretty much protected by this. Now, that said, there was a proposal made by the TPP that would make AMV making and other such copyright violations (as they deemed a violation) a crime punishable by prison time. So know the possible future risks if you want to really get into it.
Now, the second paragraph: There is actually no legal reason for it to be there, but it shows that I respect the creators, and in a way promote their work. They’re more likely to leave me alone when I’m telling them straight to their face “hey, I like you’re stuff and I’m not profiting off of your creation. I want other people to like and buy it too. And not only that, I know I have a creative voice, and I’m going to let people know that what I married to your creation may not actually be your vision.”
The truth is this. I have a lot of respect for people who make original works. I know it takes a lot of work and a lot of manpower in some cases. However, I’m also thoroughly convinced that copyright is the dumbest idea on the planet. There have actually been studies to show that people still pay for things they like even when they aren’t required to (meaning the artist/author asks for donations only). And that’s exactly what it comes down to. Money. But it goes even deeper than that, because there are no “original” works anymore. New works in movies, books, and even music rip off already existing works. Everything in these industries have been remixed so many times that nothing can be truly called original anymore. For instance, the movie, The Matrix ripped an entire scene shot-for-shot straight from the Ghost In The Shell movie. True story. This kind of thing happens all the time. So, when I see that kind of thing, I don’t think makers of AMVs are doing anything wrong. They shouldn’t have to ask for permission, and they shouldn’t be punished for remixing something that’s likely already a remix of something else.
