Unlike discrimination claims where damages are substantially limited, workplace sexual harassment and assault claims that can be pursued as assault, battery, and negligence claims (e.g. negligent supervision, negligent retention) are not subject to the same damages caps. Assault/negligence claims often provide for far more significant damages.
