In this video, we discuss one of the most misunderstood topics of cyber law — whether liking or reacting to an obscene post on social media is an offence under Section 67 of the Information Technology Act, 2000.

Many people fear legal trouble just for clicking “Like” or reacting to a post they didn’t even upload. The Allahabad High Court, in the landmark case Mohammad Imran Khan vs State of Uttar Pradesh, clarified that merely liking an obscene post does not amount to publishing or transmitting it. The Court held that a simple “like” is a passive reaction, not a criminal act.

However, uploading, sharing, forwarding, or transmitting obscene photos or videos is punishable under Section 67 of the IT Act. The difference between liking and sharing is crucial — liking remains on your profile, but sharing circulates content publicly, which can make you legally liable.

We also discuss how the Supreme Court of India, in the Aveek Sarkar judgment, moved away from the old Hicklin Test and adopted the Community Standards Test, defining what constitutes “obscene.” Further, in Shreya Singhal v. Union of India, the Court struck down Section 66A, protecting online free speech.

Together, these judgments show that Indian courts protect freedom of expression while also upholding decency and public morality.
