Second Schedule, Para 6

The management committee may employ, for and on behalf of the management corporation, such agents and servants as it thinks fit ON A YEARLY BASIS, in connection with or to facilitate the exercise of its powers and duties.

⚠️ WHAT THIS REALLY MEANS (IN SIMPLE TERMS)

✔️ MC has power to appoint agents (e.g. managing agent, staff)
❌ BUT appointments are NOT indefinite
❌ “We’ve used them for years” ≠ automatic approval
❌ Annual review / renewal is expected

👉 “On a yearly basis” matters.
It means:
▪️ Appointments should be reviewed yearly
▪️ MC must be able to justify continuation
▪️ MC cannot treat agents as permanent fixtures

⚠️ Blind renewals = governance risk.

COMMON EXCUSES — ALL WRONG ❌

“We’ve always used the same agent”
“No one complained”
“It’s easier not to change”

❌ None of these override Para 6.
