CAN I SMOKE POT IN PUBLIC IN LAS VEGAS?

Adults age 21 and older in Nevada may now legally possess up to 2.5 ounces of marijuana (or up to 1/4 ounce of marijuana concentrate).

However, the only place it is legal to smoke or ingest marijuana in Nevada is a private residence. Therefore people may not smoke pot in public, and that includes restaurants, bars, parks, casinos, hotels rooms, national forests, and even the dispensaries where marijuana is bought. It is also illegal to smoke on federal land as well as in vehicles.

Public consumption of pot is punished as a misdemeanor, and the penalty is a fine of up to $600.

If you driving with your ounce or less of legal marijuana, it is best to keep it in a sealed container in the trunk so you do not run afoul of open container laws.

If you are caught smoking while driving, you face DUI charges, which carries much steeper punishments than public consumption. In addition to a fine, a first-time DUI charge usually carries DUI school, a victim impact panel, a suspended jail sentence of six months, and a three-months driver’s license suspension.
