Due to freedom of information and access, public citizens are granted insight to the court system and other government agencies. Public opinion and interest may at times impact the privacy and impartiality of court proceedings and court records, however, these freedoms are incredibly valuable. Public access to records and proceedings holds the courts accountable by ensuring any errors, oversights, and injustices are perfectly transparent. Ultimately, this freedom helps elevate our justice system to the highest standard of accuracy and integrity.

The Supreme Court consistently has recognized that the public and press have a presumptive First Amendment right of access to judicial proceedings in criminal cases.  See Richmond Newspapers, Inc. v. Virginia, 448 U.S. 555, 573 (1980) (plurality opinion)

Likewise, the First Circuit has held that under the First and Fourteenth Amendments, “the public and the press enjoy a constitutional right of access” to criminal proceedings, “most pretrial proceedings[,]” and “to documents and kindred materials submitted in connection with the prosecution and defense of criminal proceedings.”  In re Providence Journal Co., 293 F.3d 1, 9 (1st Cir. 2002).
