When can the police arrest you for "failure to disperse"? What about your Constitutional rights to freedom of speech and assembly?

People have a basic right to assemble, protest and exercise their free speech. This is guaranteed by the First Amendment of the US Constitution. Police cannot order a crowd to disperse just because they disagree with their message (such as protesting police abuse).

However police can order the crowd to disperse if it becomes unruly or violent and the protesters pose a danger to themselves or others or public or private property. People who refuse to disperse at that point could be arrested and charged under Penal Code sections 409 and 416.
