Using anonymity to protect your real estate is a core strategy of asset protection. Plaintiff attorneys are deterred from seeking vengeance against those they perceive to have no assets. This is typically accomplished with real estate through the use of land trusts with a nominee trustee and LLCs filed in Wyoming or Nevada using a nominee manager. Future LLCs are set up as member managed with the Wyoming or Nevada LLC listed as its sole member. With this type of structure, you can create anonymity for all of your business interests because nothing will point to you, everything will point to Wyoming or Nevada and you nominee manager.

Although this strategy has served my clients well over the years, it is not appropriate in every circumstance. Assume you are a real estate flipper that uses hard money to fund your deals. If you set up a corporation in Wyoming and nothing is traced back to you, this can make it difficult to borrow money. A lender will want to see you name associated with your business and if all the lender can see is your nominee, your ability to obtain financing is greatly diminished. Thus, when if comes to using anonymity keep in mind it can be a hindrance to borrowing money. If you plan to use financing then operate your financing through an entity you name is associated with on the public record and hide everything else.
