India’s land administration system still runs on a colonial framework built for revenue extraction, not public service. In this conversation on The Secretariat, B.K. Agarwal, Former Chief Secretary, Himachal Pradesh, and Former Secretary (GoI), argues that the time for minor tweaks is over.
With land records now fully computerised across states, Agarwal says India has a rare opportunity to rethink how land is governed, recorded and disputed. He adds that small, incremental changes will not do. Today’s requirement is to take a leap beyond the legacy, calling for a fundamental shift in laws, procedures and institutional thinking.
He flags gaps that continue to fuel disputes, from fragmented land records maintained by different authorities to long-pending revenue cases and outdated registration exemptions. Technology, he stresses, can help but only if backed by legal reform. “Only technology cannot transform land administration unless it is supported by changes in the law,” Agarwal notes.
He also makes a case for opening parts of the land ecosystem to the private sector under strict safeguards, arguing that government alone cannot deliver efficient, citizen-friendly services at scale.
As India considers a new Registration Act after more than a century, Agarwal says the moment demands ambition, speed and political will, not another decade of half-measures.
