Reality of ''old cars ban"in India?

Reality of "Old Cars Ban" in India 🚘💭
There is no nationwide blanket ban on old cars (e.g., vehicles over 15 years old) in India as of December 2025. Rumors or claims of a complete national prohibition on older vehicles are inaccurate. Instead:
National Vehicle Scrappage Policy (introduced 2021, updated/enforced progressively in 2025): This is a voluntary-turned-mandatory framework to phase out unfit and polluting vehicles for environmental and safety reasons.
Private vehicles (cars/bikes) over 15 years must undergo mandatory automated fitness tests at registered centers.
Commercial vehicles often face stricter rules (e.g., over 8-15 years, depending on type).
If a vehicle fails the fitness test (with one re-test allowed after repairs), it must be scrapped at a Registered Vehicle Scrapping Facility (RVSF).
Scrapped vehicles are deregistered and cannot be used on public roads.
Incentives include: scrap value payout, road tax rebates (up to 25%), registration fee waivers, and OEM discounts (4-6% on new vehicles) when buying a replacement.
Government vehicles over 15 years are mandatorily scrapped in many cases.
This policy aims to reduce pollution but is not an automatic age-based ban—well-maintained older vehicles can continue if they pass tests.
The policy is incentive-driven nationally, with states adding their own rebates or rules. It's not a "ban" but a system to encourage scrapping unfit vehicles.
Strict Ban in Delhi-NCR Only: A separate, court-mandated rule applies specifically to the National Capital Region (Delhi and surrounding areas like Noida, Gurugram, etc.) due to severe air pollution.
Diesel vehicles over 10 years and petrol/CNG/LPG vehicles over 15 years are considered "end-of-life" and prohibited from plying on roads (based on NGT orders from 2015, upheld by Supreme Court in 2018).
Enforcement attempts in 2025 (e.g., fuel refusal at pumps starting July 1, later planned for November) faced backlash and were paused.
As of August 2025, the Supreme Court issued an interim order: No coercive action (e.g., impounding, fuel denial, fines) against owners of these vehicles until the case is fully heard. This provides temporary relief, and older vehicles can currently be used in Delhi-NCR without immediate penalties (pending final verdict).
Owners can now more easily obtain NOCs to transfer/re-register vehicles outside NCR.
In summary:
Nationwide: No outright ban—focus on fitness testing and incentives for scrapping.
Delhi-NCR: Strict age-based restrictions exist on paper, but enforcement is currently halted by Supreme Court order.
Outside polluted urban areas like Delhi-NCR, older vehicles can often be re-registered or used if they meet basic standards.
If you own an older vehicle, check your state's RTO rules, get a fitness test if required, or explore scrappage benefits for a new purchase. For the latest official updates, refer to the Ministry of Road Transport and Highways website.
