What is a Further Particulars Notice in Defamation Law?

If you’ve received a vague concerns notice — or if you’re defending a defamation claim — you may need a powerful tool called a “further particulars notice”. Let me explain.

Under the Defamation Acts across all Australian states, if a concerns notice is too vague, the publisher can issue a further particulars notice.

This is a formal request asking the complainant to:

• Clarify the location of the material,
• Specify the defamatory meanings, and
• Explain the serious harm or financial loss they claim.

The law doesn’t allow fishing expeditions — you can’t demand evidence, just clarification.

But if the complainant doesn’t reply properly within 14 days, the original notice is treated as if it was never served.

This is a crucial procedural advantage for defendants. It can delay or even block defamation proceedings entirely.
