Actual physical control (APC) is a crime in which a person is in physical control of a motor vehicle while under the influence of alcohol or drugs. To be charged with APC, the state does not have to prove that the person was actually driving the vehicle, but only that they had the ability to drive, such as having the keys in their possession. The law is meant to address situations where a person has been drinking or taking drugs, gets into a car and falls asleep, but still poses a potential danger to others on the road. APC can be charged even if the person is not drunk, but under the influence of drugs, including marijuana or prescription medication.
