WHEN CAN I DRIVE AFTER DRINKING?

The question supposes that an answer is possible. It isn’t. People assume that there is some scientific answer as to when they may be fit to drive after drinking. There isn’t.

There is no way of knowing at what point a person’s blood alcohol level falls beneath the legal limit.
Each one of us is unique and each one of us processes alcohol differently. You and I may drink the same type and quantity of alcohol over the same period of time but when we decide to stop drinking, you may be under the legal limit and I may be over.

Why is this?

You may have a bigger build than me, may be more used to drinking than I am, may have consumed food during the day (when I didn’t) and may be at peak physical fitness (while I may have a flu). In both our cases we have consumed the same but our bodies are processing alcohol completely differently.

Some points on drink driving.

You should not ever drive after having consumed alcohol. That is basic common sense. The Medical Bureau of Road Safety produces annual reports every year. Year on year they release broadly the same findings with respect to one factor: the time of arrest.

50% of all people arrested for drink and drug driving are arrested during the weekend i.e. between Friday and Sunday nights. The peak times for arrests are between 10pm and 2am.
And while arrests taper off after 2am, they do not stop. The Bureau report from 2021 shows that arrests begin to pick up by 6am and are on the rise every hour afterwards.

This is because the Gardai are manning checkpoints all night and throughout the day.
The existence of checkpoints at 6am and 7am are designed to detect those people who are over the limit from the night before.
You may have been out the night before and you may even have slept afterwards but if you are getting up for work there is a strong likelihood that you might still be over the limit.

The safe answer to the question of when you can drive after drinking is to make sure that you do not consume so much alcohol the night before especially if you have to be on the road early the next morning.

I have learned from many clients across the country who honestly but mistakenly assumed that even by 9am the next morning they would be in their assessment “ok to drive” that this is not the case.

I have heard from clients arrested at 11am, not because of some poor driving but because they were stopped and had to provide a breath specimen at a checkpoint.
They have been horrified to discover that they are still over the limit.

The important take-away here is that we are not objective when it comes to ourselves. We apply different rules to others than to ourselves.

We imagine that others shouldn’t drink the night before an early car journey but that we are different.

We delude ourselves into thinking that we’re ““good and safe drivers and that we “would instinctively know” if we were unfit to drive.

But all of this misses the point: we are very poor judges of ourselves to begin with and many people have approached checkpoints without any indication of poor driving (no swerving or erratic driving) only to provide roadside breath specimens that exceeded the legal limit.
