A person was charged for importing and possessing marijuana with the intent to distribute. The person's co-defendants were found guilty, except for one. The person's appeal was delayed, and he raised an issue about the admission of a statement made by his co-defendant. Customs agents observed the person in frequent conversations with two crew members on a Colombian freighter, the Francisco Miguel. Later, the person and two others were seen dragging four large bales containing marijuana. During the arrest, one defendant was heard saying in Spanish to another, "Why so much excitement? If we are caught, we are caught." The most relevant fact to the court's analysis was whether the defendant's silence was an admission of guilt.
