A tense moment unfolded during a congressional hearing as a U.S. senator questioned a 23andMe executive about genetic privacy, biological sex reporting, and the handling of children’s DNA.

The executive confirmed that any future buyer of 23andMe would be required to follow the same privacy standards, including limits on selling genetic data. She explained that the company analyzes over 600,000 genetic markers to provide ancestry, traits, and health-risk insights — while acknowledging that DNA testing cannot predict disease with certainty.

The exchange intensified when the senator challenged the company’s approach to sex determination, highlighting the difference between biological sex based on chromosomes (XX or XY) and self-reported sex used to tailor health reports.

Lawmakers also raised serious concerns about minors. While parents can consent to DNA testing for children, the executive admitted she did not know how many of the company’s 15 million users are under 18 and declined to commit to permanently deleting or never selling children’s genetic data.

Experts warned that children’s data protections apply even during bankruptcy, but lawmakers questioned whether existing safeguards are strong enough as the genetic testing industry rapidly expands.
