The primary duty of a society is to ensure justice for all. To achieve this noble goal, the traditional Panchayat system can be revived as a strong platform.
1. Speedy Case Settlement & Role of Panchayat
• Settlement of Negotiable Cases:
Nearly four million cases are pending in lower and higher courts. Cases that can be resolved through mediation must be expedited via the Panchayat system.
• Collaboration:
Active cooperation from district judges and police is essential for successful implementation.
2. Transparency in Judges' Promotion
• Evaluation Method:
Promotion should be based not only on seniority but also on departmental exam scores and fair evaluation of the Annual Confidential Report (ACR).
• Maintaining Seniority:
Strict caution must be taken to avoid violations of seniority so that no qualified judge is deprived.
3. Formation of the 'HIKMAH Group'
• Need:
If we fail to protect judges or the entire judicial system, then justice itself will not be able to protect us.
• Formation:
Experienced and respected elders known for wisdom, problem-solving ability, and being primary witnesses to social matters should be included in the ‘HIKMAH Group’.
• Philosophical Basis:
Inspired by how Allah granted Hikmah (wisdom) to Prophet Dawud (AS), this group may use prudence and wisdom to resolve matters not explicitly addressed in the Qur’an.
