D K Shivakumar said, "The land which I had bought was denotified almost 20 years back. However, it was not published in the state gazette. BDA had several correspondences with the state government stating that of the land notified, only around 20 guntas were required for laying roads and the rest was excess land not required for the formation of the layout. Even former chief secretary (B K) Das had visited the spot several times and arrived at the conclusion that the excess land was not required. When I applied for the plan sanction, H D Kumaraswamy was the chief minister. He played some dirty games and one official put down conditions that the plan would be approved provided the notified land was denotified."

When he was asked why former owner of the land B K Sreenivasan had to make a representation to the state government to denotify the land, Shivakumar said, "As the process of denotification had taken place long back itself, Sreenivasan made the representation to the state government. Whatever has appeared in the gazette notification is just a formality and there is nothing special in it. I have not sought any favour from the state government. I have all the documents to prove my stand and my personal secretary, Chandrashekar, will call you to give more details."

When he was asked which year the land was denotified, he said, "I will get back to you." After a few minutes Shivakumar called back and said, "Denotification was done in 1991. My personal secretary will call you to give more details."

His personal secretary, Chandrashekar, said, "BDA had issued only a preliminary notification for acquisition of the land. B K Sreenivasan had already converted the land for industrial purposes. After issuing the preliminary notification, BDA found that only 24 guntas was required for laying roads and the remaining land was not required. BDA had taken up procedures for denotification of the land and they did not acquire the land. We came to know about the issue while seeking permission for the plan sanction after signing an agreement with a builder."

Though Chandrashekar claims that only a preliminary notice was issued on the property, the notification issued on May 13, 2010 clearly states that the final notification on acquisition of the property was issued on October 23, 1986.
