In 2018, an RV-driving criminal attorney from WV was found with multiple different narcotics near the meth capital of the Shenandoah Valley. Six months later, an Augusta County Grand Jury indicted Kirk Bottner, then 50, for felony distribution and 3 counts of possession. Six months later, Bottner pleaded guilty to four misdemeanors, received deferred dispensation, and had charges dismissed exactly one year later. It was Bottner's second known drug arrest in Virginia since 2008. Bottner continued to serve as a Mental Hygiene Commissioner for Jefferson County, approving the sale of real estate for a protected person in 2020. Two years later, the Supreme Court of West Virginia suspended Bottner's law license for six months without citing cause. It was the Court's second disciplinary action against Bottner following a conflict of interest reprimand in 2011. As of 2025, Bottner continues to be listed as an active attorney and Mental Hygiene Commissioner for Jefferson County. It's unclear if any news outlet in the Eastern Panhandle has ever reported on Bottner's criminal activity or legal misconduct.
