An officer with the Florida Fish and Wildlife Commission (FWC) and two senior officers patrolled Sister's Creek at Jim King boat ramp. They conducted a vessel stop with emergency lights activated. A Sea Hunt vessel, *******, entered the slow-speed zone but failed to reduce speed within the required 300-foot radius.

After the initial vessel stop, the officers stopped the Sea Hunt vessel to explain the violation and conduct a safety inspection. The operator, appearing sunburned and slurring his speech, was asked to provide life jackets, a throwable device, and a whistle or horn. He seemed confused, repeated the request, and struggled to retrieve the items, displaying instability and fine motor impairment.

The officer then requested a fire extinguisher, registration, and the operator’s age. He stated he was almost 39 but had difficulty recalling the correct registration sticker color. When asked about alcohol consumption, he and a female passenger denied drinking. However, the officer detected a strong alcoholic odor from the operator. He also struggled to retrieve his ID, requiring assistance.

The officer requested the operator to board the patrol vessel for an eye check. The operator hesitated, stating he did not know what to do. A senior officer informed him that boarding was required. The operator was given a life jacket and assisted onto the patrol vessel, where the alcoholic odor was again detected. When asked if the life jacket fit, he responded, "I'm getting ready to go to jail so..." though he had not yet been arrested.

The officer read instructions from the Seated Battery of Standardized Field Sobriety Tasks (SFSTs). The operator refused to perform the tasks, leading the officer to base decisions on observed impairment. When asked again, the operator confirmed his refusal.

At this point, the officer placed the operator in handcuffs and informed him of his arrest for Boating Under the Influence (BUI) with impaired faculties. He was asked if he needed anything before transport and opted only to contact his partner. The vessel was released to a pregnant passenger who stated she had not been drinking.

At 1900 hours, the officer read the Implied Consent Warning for Breath (BUI). The operator refused the breath test and claimed not to understand the implications. When asked about prior refusals, he stated he had none. He ultimately confirmed his refusal.

The operator was transported by water to Duval County Jail without incident. He remained respectful and compliant throughout. The officer’s body camera recorded the incident.
