William S. Klocek sued Gateway and Hewlett-Packard for breach of contract and warranty over the purchase of a computer and scanner. Gateway argued that the case should go to arbitration due to a clause in their Standard Terms and Conditions Agreement. The court determined that it first needed to establish where the last act of the transaction occurred to determine which state's law applied. The court found that Kansas law applied, and that the Standard Terms did not become part of the agreement due to UCC § 2-207. The court also noted that the plaintiff's claim for damages in excess of $24,000 was dismissed.
