SA-Israel ICJ case | John Dugard SC

John Dugard SC talked about jurisdiction. He detailed South Arica’s long history with Israel, and the attack of 7 October, but how that then unleashed a horror on the Palestinians of Gaza. South Africa warned Israel of its objections. He also detailed the continuing horror that Cyril Ramaphosa continues to condemn. Israel has not responded to the communications. Israel began denying the claims of genocide in early December. South Africa had already accused Israel at the UN General Assembly and in the Security Council, and called on the ICC to look into acts. Despite the harsh accusation, Israel has persisted in its actions, which is why this case is so necessary.

The ICJ has a number of tests whether a dispute exists. Israel is well aware of South Africa’s attitude, communicated as such, and the acts continue. Israel described the allegations as ‘obscene’. For provisional measure, need to show there is a basis for prima facie case. It is well proved.
