The cop who killed Josh Phipps, our hero, should be charged with Reckless Homicide (KRS 507.050), if not Manslaughter 1 or 2, or 1st degree Murder itself. 2nd degree Manslaughter (KRS 507.040) is the "wanton" death of another person. Wanton means "deliberate & unprovoked". 1st degree Manslaughter (KRS 507.030) is when a murder happens "with the intent to cause serious physical injury", ... "or of a third person", ie an innocent bystander, or friendly fire. A person is guilty of 1st degree Murder in Kentucky (KRS 507.020) when "with the intent to cause death of another person", he or she causes a death of that person "or a third person". That "or a third person" means of an innocent bystander, or of friendly fire.

At the very least, the cop who murdered Josh Phipps should be charged with Reckless Homicide KRS 507.050, because if that cop was being reckless, then he would be guilty of that crime. An honest court & cop system should try him, at the very least to exonerate him by a jury of his peers. Is there probable cause that a crime was committed in Russell County? Well, there is a dead body. Maybe a crime occurred, maybe not. But there's obvious & clear probable cause of that crime happening.

"Sometime between 6 and 6:30 this evening, reports came in of an active shooter in Russell Springs after a shooting occurred near Bluebird Drive. While Kentucky State Police has not yet released an official statement, WJRS News is told state police attempted a traffic stop on a vehicle near mobile homes on Bluebird Drive when the driver of the vehicle fired a weapon at the trooper. Details remain unclear at this time, but we’re told Deputy Phipps arrived as backup to the situation, and the shooter fired at Phipps, striking him. Phipps was taken to Russell County Hospital, where he passed away. A convoy of local first responders escorted the body of Deputy Phipps to the state medical examiner’s office in Frankfort. A heavy police presence with several units from Kentucky State Police were on scene on Bluebird Drive. We’re told the shooter was shot by law enforcement, and reports are that he passed away as well. Reports of a shooter at the Russell Springs City Park were also called in. We spoke to officials with Kentucky State Police on scene on Bluebird Drive tonight. They told WJRS those reports were investigated and there was not a threat to the public. The reports, however, did cause evacuations from the park with multiple youth sporting events occurring there. There were reports of multiple shooters at large, but state police officials told WJRS News there was only 1 shooter."

Only 1 shooter? Just the cop shooter? Or are they claiming that Josh Arnold had a gun, & was shooting at them? Was he shooting back at them, or did he start firing first?

I'm also wondering about the murder of Josh Arnold, what were the circumstances to that? When will they release the body & dash cameras, if ever? If the cop who fired shots was in danger of serious bodily injury or was in fear for his or her life, then it's justified. I hope they didn't shoot him in the back. To shoot somebody dishonorably in the back, in the wild west, that's enough to get a person hung.
