As we all know, history is full of some pretty terrible injustices. Just take the story of D.M. Bennett, for instance.

Never heard of him?

He was a publisher who, in 1879, was arrested, convicted, and sentenced to 13 months of hard labor in Albany prison for violating the Comstock Act. His crime? He mailed a copy of an anti-marriage tract titled “Cupid’s Yokes, or The Binding Forces of Conjugal Life,” which Anthony Comstock considered obscene.

In reality, Bennett was targeted because he actively campaigned for the repeal of the Comstock Act.

Let’s not mince words: the prosecution of this ordinary America for expressing a political opinion is grossly unconstitutional, violates the letter and spirit of the First Amendment, and is a stain on America’s commitment to free speech.

It was cruel and corrupt, full stop.

But do you know the worst part? That law, the Comstock Act, is still on the books——and it threatens your rights.

You see, the development of First Amendment law through the 20th century essentially beat the Comstock Act down to its last breath. But the law itself was never repealed in all those years.

Now, 145 years after Bennett was jailed, the law is showing signs of life as some judges and members of Congress toy with bringing back Victorian era legal standards.

Recent cases in Texas and even the Supreme Court have threatened to resurrect it—putting everyone’s First Amendment freedoms at risk.

And I do mean everyone.

Republican, Democrat, independent. Religious and non-religious. Pro-life or pro-choice.

Everyone. Including you.

We cannot allow the use of Victorian Era laws to undermine the rights of American citizens.

That’s why the Foundation for Individual Rights and Expression filed a petition on June 17 on behalf of freethought publisher Roderick Bradford, calling on President Joe Biden to posthumously pardon one of the Comstock Act’s prominent victims, D.M. Bennett.
