Under Section 17A of the Prevention of Corruption Act, 1988 (inserted in 2018), no police inquiry, investigation, or enquiry can begin against a public servant without prior approval if the alleged offence relates to a decision or recommendation made in official capacity.

✅ Approval required from:

Central Government (for central officials)
State Government (for state officials)
Competent authority (for others)

🚨 EXCEPTION:
No approval needed if the public servant is caught red-handed accepting or attempting to accept a bribe.

🕒 Decision on approval must be given within 3 months, extendable by 1 more month with reasons.
