Personal information is any information from which one can identify a natural person. This includes name, address, or such indicators by which employees can be identified.
Sensitive personal information includes passwords, financial information (bank or card details), physical, physiological, and mental health conditions, sexual orientation, medical records, history, or Biometric information.

As per the IT Rules of 2011, employers are required to comply with certain obligations while collecting these types of information, such as:

1. Publishing a privacy policy: The employer must publish it on the company’s website and premises.
2. Obtaining informed consent before collecting such information: This should be in writing and documented.
3. The information must be collected only if necessary and for a lawful purpose connected with a function of the company.
4. Employees have a right to not consent, or later withdraw consent for collecting this info.
5. Employers cannot retain such data longer than is required for legal purposes.
6. For disclosing or transferring such information, the employer requires the employee’s consent. This can be done without consent only if the employee’s contract says so, or to meet a legal obligation.
7. A grievance officer has to be provided to address any discrepancies and grievances of information providers.
