Hi, it’s Mike DelSignore. I want to talk about what happens if you’re arrested for OUI in Malden District Court after leaving Encore Casino. First and second offense OUIs are heard in Malden District Court, and these are winnable cases. OUI cases are hard to prove beyond a reasonable doubt because they’re subjective.
If it’s a third offense, the Attorney General—not the local prosecutor—handles the case since it involves a casino. They can be tougher, and sometimes indict the case to Superior Court because a third offense OUI is a concurrent felony. Normally, most DAs keep OUI threes and even fours in District Court, but when the AG is involved, it can be different.
If you’re arrested for OUI, remember these cases are winnable. Field sobriety tests are subjective, and breathalyzer evidence isn’t always admissible. The key is reviewing all the evidence and making the best decision for your situation. That’s what I do every day—cross-examining officers and evaluating police reports so I can give clients a realistic idea of how the case will play out at trial.
I won’t sugarcoat difficult cases, but I’ll always give you the truth. Many clients appreciate that honesty. In many cases, I’ll tell you I think we can win. I can’t guarantee results, but I’ll let you know if the case is strong enough to take to trial or better resolved.
Sometimes a continuance without a finding (CWOF) may benefit you more than a guilty finding—for example, if you have a New Hampshire license or a gun license.
