Federal Judge Warns Trump Administration on Immigration Status in Campus Protest Case


A federal judge in Boston has issued a warning in a lawsuit involving immigration enforcement and free speech on U.S. college campuses. The ruling says certain noncitizen academics may seek court protection if their immigration status is changed in retaliation for taking part in the case.
The decision was issued by U.S. District Judge William Young after a trial last year in which he ruled that the Trump administration violated the Constitution by targeting non-U.S. citizens for deportation based solely on pro-Palestinian activism and criticism of Israel. The lawsuit was brought by the American Association of University Professors and the Middle East Studies Association, which alleged that U.S. policy singled out noncitizens for detention or deportation because of political expression connected to the Israel-Gaza conflict.
In his latest order, Judge Young outlined specific conditions under which noncitizens could challenge any change in their immigration status. He said individuals would need to prove membership in one of the two organizations between March 25, 2025, and September 30, 2025, show that their status had not expired, and demonstrate that they had not committed any crime after September 30, 2025. If those standards are met, the court would presume the action was taken in retaliation for exercising First Amendment rights during the case.
The ruling followed a recent hearing in which the judge criticized senior officials, including Homeland Security Secretary Kristi Noem and Secretary of State Marco Rubio, saying their actions created a chilling effect on speech. A spokesman for the Department of Homeland Security did not respond to a request for comment.
Testimony during last year’s trial included acknowledgments from government witnesses that more than five thousand pro-Palestinian protesters were targeted in a related campaign. Plaintiffs’ witnesses said the effort created fear among academics and caused some to stop engaging in activism.
The report also references individual immigration cases tied to the broader dispute. One involves former Columbia University graduate student Mahmoud Khalil, whose release from detention was recently reversed by a federal appeals panel. The court did not decide whether the administration’s effort to deport him was unconstitutional, instead ruling that immigration court proceedings must be completed first. Another case involves Tufts University student Rümeysa Öztürk, who was released after six weeks in detention and has said she was unlawfully held after co-authoring an opinion article criticizing her school’s response to Israel’s war in Gaza.
