POSSESSION OF BURGLARY TOOLS

Under CRS 18-4-205, it is a crime in Colorado to have tools commonly used to break into a business, home or vehicle, with the intent to use those tools to burglarize. Here are three things to know about the crime of possession of burglary tools:
1) Common burglary tools include crowbars, pliers, wrenches, screwdrivers, glass breaking tools, blowtorches, key-making kits, and even certain kinds of magnets.
2) Knowingly possessing burglary tools to forcibly enter a dwelling in order to steal is a class 5 felony punishable by up to 3 years in prison and a fine of up to $100,000. People convicted of a class 5 felony can petition for a record seal three years after the case ends. Otherwise, possession of burglary tools is a class 2 misdemeanor carrying up to 120 days in jail and/or up to $750 in fines. People convicted of a class 2 misdemeanor can petition for a record seal two years after the case ends. But if the charge gets dismissed, there is no wait to petition for a seal.
