The theory of force of the origin of the state explains that the state is the child of force. Aggression, war, conquest, and subjugation were the basis of the state. In primitive times, strong men, with the help of the warriors subjugated the weaker men. After this, they established a relation of command and obedience. This was the first foundation of the state. It can be said that “War begat the king”. The strong men enslaved the weaker men and became chiefs of his tribe. The strong tribe subjugated the neighbouring weak tribes and made them subordinate. The process went on and a stage reached where the state was established. Since force was used to establish the state, the force was also necessary to maintain the control of the state. The might is right was the principle of the formation of the state.
There are certain defects in this theory as well. First of all, the theory overemphasises the importance of force in establishing the state. Other factors like religion, consent, culture, and geographical conditions are also necessary to analyse the origin of the state.
