Once a landlord files a complaint for eviction against a tenant, and the tenant is served, the tenant has five days to answer the complaint. If the tenant fails to file an answer with the court, the landlord is entitled to a judgment for possession. In that case, the clerk will issues a Write of Possession, which is sent to the Sheriff's Department, and the Sheriff will then proceed to execute the writ and remove the tenant and the tenant's belongings from the premises. If there is a court date and the tenant does not show up, generally the court will enter an order evicting the tenant. If the landlord fails to show for a court date, generally the court will dismiss the landlord's case against the tenant.
