United States v. Klein | 80 U.S. 128 (1871)

In an effort to reduce the economic damage caused by the Civil War, Congress and President Abraham Lincoln worked together to create a solution. However, this solution pitted Congress against the Supreme Court in a struggle for power in the 1871 case of United States versus Klein.

In 1863, Congress passed an act that allowed the government to seize property if the property had been used to aid or abet the Confederate rebellion. The government seized and sold V.F. Wilson’s cotton farm pursuant to this act.

Following the 1863 act, President Lincoln made a proclamation pardoning anyone who supported the Confederate army, but only if that person took an oath of allegiance to the Union. Wilson, and many others who were caught on the losing side of the war, accepted President Lincoln’s pardon and swore an oath to the Union.

Shortly after swearing the oath, Wilson passed away, leaving the administrator of his estate, Klein, to file a lawsuit in the Court of Claims seeking to recover the proceeds from the seized and sold cotton farm. The Court of Claims decided that Wilson’s estate was entitled to the proceeds and awarded it one hundred and twenty-five thousand dollars. The United States appealed to the United States Supreme Court.
