Web design agencies and web developers are often indirectly involved with ADA compliance lawsuits because they help build websites for clients. This can lead to tension between the provider and client when clients are sued over accessibility.

Generally, service providers should not be responsible for creating accessible websites (and other digital assets) unless accessibility and WCAG conformance was bargained for in the original agreement. This is because accessibility is very much an additional or special consideration that is not yet a standard industry custom.
