Many people wrongly assume that daughters receive the entire property or that male relatives automatically take control. Property Distribution According to Islamic Law
▶ Case 1: Only One Daughter

If the deceased leaves behind one daughter only and no son:
The daughter receives 1/2 (50%) of the total property
The remaining 1/2 is distributed among other legal heirs such as:

Father
Mother
Husband or wife
Brothers or sisters (according to Shariah order)

▶ Case 2: Two or More Daughters

If the deceased leaves two or more daughters and no son:
All daughters collectively receive 2/3 (66.66%) of the total property
The remaining 1/3 is distributed among other legal heirs
The daughters divide their share equally among themselves

Share of Husband or Wife

If the deceased is a man and his wife is alive:
The wife receives 1/8 of the property (when children exist)
If the deceased is a woman and her husband is alive:
The husband receives 1/4 of the property (when children exist)

Share of Parents

Mother: Receives 1/6 if the deceased has children
Father: Receives 1/6 and may receive additional share as a residuary heir
Do Brothers Take the Daughters’ Property?
No. Brothers do not automatically inherit when daughters are present. They only receive a share if property remains after fixed shares are given to daughters, spouse, and parents.
Distribution Under Pakistani Law
Pakistan follows Islamic inheritance law under:
Muslim Personal Law (Shariat) Application Act
West Pakistan Muslim Personal Law (Inheritance) Rules
Daughters have a legal, enforceable right to inheritance. Denying daughters their share is illegal and punishable under Pakistani law.
Can Property Be Given to Daughters During Lifetime?
Yes. A person may distribute property during their lifetime through:
Gift (Hiba)
Will (Wasiyyat) – up to one-third of the property
