The Fifth Amendment prohibits the government from “tak[ing]” “private property” “for public use” without paying “just compensation.” This provision implies, conversely, that the government may permissibly take private property for public use with just compensation. In this part we consider two questions raised by the text of the Fifth Amendment. First, what is a “taking”? Pennsylvania Coal Company v. Mahon (1922) and Penn Central Transportation Company v. New York (1978) addressed this question. Second, what is a “public use”? Kelo v. City of New London (2005) answered this question.
