DUID
In Nevada, driving under the influence of drugs is prosecuted the same as drunk driving. It does not matter if the drugs were obtained through a valid doctor’s prescription.
First-time DUI defendants can usually avoid jail as long as they pay a fine, complete DUI School, and attend a victim impact panel. And first-time DUI defendants can usually keep driving during the 185-day driver’s license revocation period as long as they install an ignition interlock device in their vehicles.
The main difference between drunk driving and drugged driving cases is what happens following the arrest. Defendants suspected of being under the influence of only alcohol are given the choice of taking a breath test or a blood test. But if the police believe the defendant is under the influence of controlled substances or other drugs, then the defendant has to submit to a blood test since breath tests cannot detect drugs.
When defendants refuse to take a blood test, the police will confiscate their driver’s license, obtain a warrant, and use reasonable force in order to administer the blood test. Refusing to take the blood test carries a one-year license suspension, even if the DUI charges get dropped.
Potential defenses to drugged driving charges are that the blood samples were contaminated, that the police had insufficient probable cause to make an arrest, or that the defendant did not start ingesting drugs until after being pulled over by the police.
