When a cheque bounces, the matter is not directly taken to the court. A procedure needs to be followed by giving enough time and scope to the payee to make such payment which includes sending a legal notice.

The Legal notice is the last step or the last opportunity to the payee to make the payment before the matter is taken to the Court.

To deduce in simple words, legal notice is a written document sent to a person, a company or any other entity to inform regarding the grievances caused by such person, company or entity.

The legal notice can be considered as a warning to the receiver that the person who has hired a legal consultant has certain grievances which have not been addressed properly by the person receiving the legal notice when the sender has informed regarding that informally or following all the procedure prescribed by the receiver (like calling to the customer care, in person, or sending an email).

A legal notice is formally informing the receiver that the sender is serious about the grievances, and it is the chance for the receiver to settle the matter before it gets filed before a court and legal procedure starts.

There is a specific format which is followed by lawyers to frame a legal notice are as follows:

1) All the required facts stating the grievance in brief which led to taking a legal action.
2) The grievances must have raised due to any reason in control of a payee. Any reason due to natural disaster or Act of God shall not be considered.
3) The relief sought in money, kind of service from the person, or company to whom the legal notice is being sent. This may include extra cost that has been incurred due to such delay.
4) The laws under which the relief is being sought or action to be taken from the receiver.

The points which should be noted when a lawyer writes a legal notice on his letterhead, are as follows:

1) The legal notice must be drafted in an unambiguous language to be understood by the receiver, in the language the receiver can understand, such that reader and the sender are on the same page.
2) The necessary details like names of involved persons, their address, contact information, grievance caused, date and time when the grievance was caused, previous attempts of contacting the person or company for resolving the dispute, and any document or evidence in relation with the grievance. All information should be accurate and clear. Any mistake may cause a hassle for the sender, making his side weaker.
3) The reason for sending the legal notice and stipulating the conditions to be followed within a reasonable period of time which varies in different matters, usually 30-60 days. In case, there is any delay, there must be enough reason justifying such delays.
4) Signed by the person sending the legal notice and the lawyer drafting it and, the rubber stamp of the lawyer must be clear and prominent.
5) The Registration Number of the lawyer must be present either on the letterhead or in the rubber stamp.
