Hello everyone, today we shall discuss the Maharashtra Regional and Planning Act 1966

The act was built to plan the development of the regions under Maharashtra government.

the purpose was to provide provision for preparation of development plans and town planning.

This act was enforced to implement schemes like town development regulations, land acquisition, plot reconstitution.


The people who are part of this act are:
Regional Planning Board
Regional Planning Committee
Planning Authority
State Government
Public

The Regional planning committee looked after the;
Allocating regions for different purposes
Reservation of places for open spaces and recreation
Green field development
Preserving heritage areas
Area allocation for military and defense purposes
Distribution of population

whereas the Planning Authority or the town planning committee will look after the following:
Allocating land to people for different purposes
Reserving areas for parks and recreation.
taking care of public utilities and amenities like water supply, drainage etc.
Area distribution for service industries and industrial estates.
To regulate development control regulations.

the major factors of this town planning scheme are:
Giving ownership, area and tenure of original land holdings
Details about reservations, acquisition or allotment of land is given.
Details about extent and boundaries where plot reconstitution is required.
Total cost estimate of this scheme
And allotment of final plots to owners and transfer of ownership.

The find for all this process are acquired from:.
A part from central and state government and other organizations.
Budget allocated by the state government to the planning Authority.
Funds collected from the public by way of Development charges and fees, betterment charges, development permission charges.

Kangna's office was demolished under sec 52 of this act which specifies about the illegal development and construction.

The govt has the right to take action against illegal construction.

The BMC had to give a notice for this illegal construction and not to take action before one month of such notice.
But they invariably took action before the end of notice period.

A bill is even passed by BJP led govt that illegal construction can be legalized by paying a penalty fee.

If such recourse is available then it was completely illegal to demolish the office.
The fact that High Court has given a stay on this demolition confirm that this was an unnecessary and unlawful step by BMC.

The government being the caretaker of whole Maharashtra, they should look into more severe matters like unemployment and homelessness and not to make the people homeless.

The recent amendment is that plots less than 1500 sqft. need no permission from BMC for construction.
