Under the California Equal Pay Act, it is illegal for an employer to pay you less than a coworker of a different gender or race for doing substantially the same work. The only valid reasons for a pay difference are legitimate factors such as experience, education, training, seniority, merit, or productivity. Sadly, many employers still violate the law—paying women less than men, or paying Black and Hispanic workers less than white coworkers for the same roles.
Wage discrimination isn’t just about your base salary. It also includes differences in bonuses, stock options, benefits, paid time off, insurance coverage, and other forms of compensation. Neil Shouse explains how to recognize wage discrimination, what evidence is most helpful—such as payroll records, emails, and witness testimony—and what your legal options are.
