Welcome to the very first of my Casenotes In Depth!

This case examines a claim by Nicaragua in the mid-1980s, alleging (accurately) that the USA was funding a rebel group called the Contras in order to destabilise the Nicaraguan government. In reality, however, the USA was far more interested in controlling the expansion of world communism, than in the question of who ruled Nicaragua.

The case is primarily remembered because the court considered the relationship between customary international law and treaty law, and found that customary law continues to exist, even when a treaty on exactly the same question of law becomes the predominant document.
