Pop quiz for all my supplement industry nerds…can you use the term “lean” on say a protein bar packaging if the product contains more than 10 g of fat, 4.5g or more of saturated fat, or more than 95 mg of cholesterol per 100g of product? If you answered “No”, you’d be right…congrats! Do you want to know who allegedly got this pop quiz question wrong? GNC. A class action lawsuit, filed at the end of February, stated that the specialty supplement retailer misleadingly marketed a collection of protein bars as “lean.” The complaint alleges that the noted GNC Lean Bar variants do not contain any less fat than typical full-fat protein products and do not meet federal regulatory requirements for making such claims. While “lean” seems like common supplement industry terminology…it also can have specific legal definitions.
