Trade dress allows you to identify the source of a particular product. For example, you can tell that a phone is made by Apple, as opposed to another manufacturer, based on the phone’s trade dress. In the 2015 case Apple Incorporated versus Samsung Electronics Company, we explore the extent to which trade dress is entitled to trademark protection.

Apple manufactured smartphones, and it trademarked certain elements of its phones’ trade dress. For example, Apple trademarked the shape, configuration, and appearance of the icons on its phones. Apple didn’t trademark other elements of its phones’ trade dress. For example, Apple didn’t trademark its phones’ rounded rectangular edges.

Samsung also manufactured smartphones. Apple sued Samsung for dilution of Apple’s registered and unregistered trade dress.

Following a trial in federal district court, the jury found in favor of Apple. The district court denied Samsung’s posttrial motions. Samsung then appealed to the Federal Circuit Court of Appeals.
