Workers' comp lawyers typically offer free consultations to discuss cases and provide guidance without any initial cost. In Illinois, the attorney fee for workers' comp cases is legally set at 20%, with two exceptions allowing for potentially higher fees under specific circumstances. The first exception is if a lawyer secures a higher settlement than a pre-existing cash offer; they can take a higher percentage of the additional amount.

The second exception allows a lawyer to petition for higher fees from the Illinois Workers Compensation Commission if they perform extensive work on the case. Lawyer fees are paid from the settlement amount, meaning clients do not pay out-of-pocket; the lawyer only gets paid if they win the case.
