Eighteenth Amendment 2010
Twenty Six members committee (11 members from mainstream parties and other members from all parties) formatted this amendment. Raza Rabbani was its head
National Assembly passed it with 292 votes out of 342 in favor, 8 April 2010 and Senate passed it with 90 votes out of 100, 15 April and it became law with the signature of President Asif Ali Zardari in 19 April 2010.
Amendments in Constitution through 18th amendment
Miscellaneous Amendments:
Expanding the definition of High treason Article 6. Cannot be validated by Supreme and other courts
Rename of Provinces:
Fundamental Rights:
1. Three rights given: Fair Trail 10A, Right of Info 19A, Right of Education 25A
2. Safeguard against Discrimination in services: Article 27
Amendment Regarding Legislature:
1. Role of Senate enhanced. Annual Principle report in Senate session, money bill for recommendation from 7 to 14 days. Senate members were now 100 to 104. Annual Sessions from 90 days to 110 days.
2. Disqualification for election to parliament article 62 and 63 for five year not for life.
3. Defection from Political Party Article 63-A Head party has defection power.
4. Removal of Intra party election
Amendment Regarding Executive:
1. Reduction of Power of President and governors under Article 58-2-B
2. According to this article now executive authority will vest on Prime Minister as Chief Executive on the name of president.
3. Presidential power to issue Ordinances one time Article 90
4. Prime minister can be elected three or more time
5. Size of cabinet shall not be more than 11 percent (49 ministers out 446) of parliament. Same rule for provincial assemblies (15 ministers).
Amendment Regarding Judiciary:
1. Islamabad High Court, Mingora (Peshawar) and Turbat (Quetta) Benches.
2. Appointment of judges under article 175-A: 7 members commission by CJ sent 8 members of parliament committee. They can accept or reject ¾ majority
3. Article 200 Judges can refuse to accept transfer another court.
4. Attorney general & advocate general bar on private practice during tenure of office.
Amendment Regarding Election Commission:
1. Permanent Election commission with 5 members and CEC chosen by PM and opposition leader three names sent to12 parliamentary committee than to president.
2. Term increase from 3 to five years
3. Devolution of power under local govt. article 140-A under election commission
Amendment Regarding Federalism:
1. Omission of sixth (35 laws) and seventh (8 laws) schedule.
2. Repeal of 17th amendment.
3. Abolition of Concurrent list
Increase in provincial list: 35 Subjects…… Education Health, Zakat Auqaf
Increase in federal list: 10 Subjects
4. For inter provincial matters …. CCI PM and 3 Federal ministers and 4 CMs.
7th NFC Award:
1. Distribution of revenue 42.5% Federal 57.5 Provinces
2. Federal Texas
3. 1 percent for KP
4. Percentage for 2010 and 2011 and onward.
5. Allocation of resources and four indicators
6. Provinces shares
