Описание к видео PC George’s bail to get cancelled? Kerala police to approach HC

#PCGeorge #AntiMuslimSpeech #PCGeorgeArrest

The police will approach the court today seeking cancellation of the bail granted to senior leader and former MLA P C George in connection with his controversial statement against the Muslims. The plea will be filed at the Thiruvananthapuram first class magistrate court. The police will inform the court that George violated bail conditions and did not hear the prosecution's arguments when bail was granted. The court had earlier criticized the police for arresting him. They were criticised for not explaining the reason for the arrest.
According to sources, the appeal would be filed with the Principal Sessions Court under Section 439 of the Indian Penal Code. The government's argument would be that the magistrate committed a procedural error in granting bail because the prosecution was not heard. The government would also claim that the lower court failed to consider the gravity of the offence committed, and that granted bail to George, who was arrested under Sections I53 A and 295 A, sends the wrong message to the public. P C George was granted bail on the basis of the feeble remand report that was filed by the police before the Judicial First Class Magistrate Court, the bail order has revealed. As per the order, the police did not make it clear in the report as to why they were moving the demand for remanding a former legislator. The court said the reported statements made by George were serious, but the police report did not say whether he had made similar remarks in the past. The only police contention was that George could influence the witnesses if released on bail. The court said the issue can be addressed by granting him conditional bail. George had sparked off a controversy by asking non-Muslims in Kerala to not go to restaurants run by the community. George's controversial statement was at the Ananthapuri Hindu Maha Sammelan organized by the Hindu Maha Parishad in Thiruvananthapuram. George said Muslims were trying to increase their population and turning into a Muslim country and that Hindus should not buy goods from the shops of Muslims.
