背景
• 申請人於2022年5月24日同時申請臨時居留証與開放工簽。
• 他先前工簽於2021年7月31日到期，但因妻子學簽已過期，申請人學簽申請於2021年11月13日被拒。 申請人稱因妻子懷孕情況危急，未能在規定90天恢復期限內申請恢復身分。
• 移民局拒絕其臨時居民申請和開放工簽申請。
• 他申請司法復核

• 2023 年申請時，女兒只有兩 (2) 歲。

Background
• The Applicant applied for both the temporary resident permit and open work permit on May 24, 2022. He claimed that he needed to be in Canada because his daughter was born in Canada.
• His previous work permit expired on July 31, 2021 and was refused extension on November 13, 2021 based on his wife's study permit. The applicant failed to applied to restore his status within the 90-day prescribed restoration period because his wife was in a critical condition due to her pregnancy.
• IRCC refused his temporary resident application and his open work permit applications.
• He sought judicial review

Comments from IRCC Officer
• The application lacked sufficient compelling grounds to warrant the issuance of a Temporary Resident Permit
• The daughter is only two (2) years old at the time of the applications in 2023. At two years, the daughter has not yet established any significant bonds in Canada that would make adjusting to life with her parents in India difficult
• Being a Canadian citizen, the daughter will be able to freely enter and depart Canada. The Applicant is able to apply outside of Canada for a temporary resident visa or work permit in order to accompany her in the future.

Comments from Federal Courts of Canada
• The Officer provided a transparent, justifiable and intelligible set of reasons. The decision was therefore reasonable.
• The application is dismissed

Lessons Learned
Everyone even a two-year old child in this case must demonstrate that he/she has established in Canada to warrant the special consideration of being issued a temporary resident permit
