On July 2, 2024, an officer of the Florida Fish and Wildlife Conservation Commission (FWC) was on patrol in Orange County, Florida, when information was received regarding an individual trespassing in a cattle pasture while picking mushrooms. The property was enclosed by a barbed wire fence.
The officer contacted the property owner, who informed them that the individual was heading east on the property toward Blitzen Avenue. Upon arrival at the location, the officer met with the property owner, and shortly after, an officer specialist arrived on the scene. The property owner then drove back to Taylor Creek Road to attempt to locate the individual.

The property owner later contacted the officer’s state-issued cell phone, reporting that the individual was walking through the pasture, heading west back toward Taylor Creek Road, and was about to go through the barbed wire fence. The officer and the officer specialist drove to the location and observed the individual crossing Taylor Creek Road, carrying a black bag. Emergency lights were activated, and a marked patrol vehicle was positioned in front of the individual.

Upon exiting the vehicle, the officer instructed the individual to stop, but the individual did not comply. Loud verbal commands were given, but the individual continued walking. The officer then drew a taser, holding it at their side while again instructing the individual to stop. At this point, the individual complied.

The individual was observed holding a black mesh bag containing numerous mushrooms. The property owner confirmed that this was the same individual who had been picking mushrooms on the property without permission. It was further confirmed that the individual had previously been issued a trespass warning. Records showed that on November 3, 2023, the individual had been issued a trespass warning for trespassing while picking mushrooms on the same property. Despite this, the property owner reported that this was the fourth time the individual had been found trespassing after receiving the warning.

The officer specialist informed the individual that they were being arrested for trespassing after warning and took them into custody. A search was conducted, and the individual was placed in the patrol vehicle before being transported to the Orange County Jail, where they were released into custody.

The officer’s agency-issued body-worn camera recorded the incident.

Florida law states that trespassing on property other than a structure or conveyance is a misdemeanor of the first degree, punishable under sections 775.082 or 775.083. If an offender defies an order to leave, communicated by the owner or an authorized person, or willfully opens a gate, door, or fence, exposing animals, crops, or property to risk, the offense is punishable as a misdemeanor of the first degree under the same statutes.
