Why is administrative law so important?
The executive - which includes all government ministries, departments, and agencies - is not only the biggest part of the government, it is also the part which deals with the common citizens on a day-to-day basis.
If you look at the scope of the work done by the executive, it is very vast.
It has to implement, enforce and administer 100’s of different laws on various subjects.
In the course of its work, the executive will also make some laws – like bylaws, rules, regulations, orders etc.
This process of the executive making some laws is called delegated legislative function – because this power to make some laws is being delegated by the legislature to the executive.
The executive also performs some functions that appear to be judicial functions – such as the functions performed by various tribunals and appellate boards, which deal with various disputes, they determine rights and even impose penalties in specific areas.
These functions of the executive, which resemble judicial functions are called quasi-judicial functions.
So, in a way, as far as the common citizen is concerned, the executive is the most powerful arm of the government. And such power should have some boundaries and safeguards.
Administrative law is important, because it governs all the activities of the executive.
It ensures that the administrative functions, the delegated legislative functions and the quasi-judicial functions of the executive remain aligned with the principles of the constitution, uphold the principles of fairness and justice; and that they follow the rule of law.
