SAN ANTONIO - Conflicting accounts are emerging after ICE agents entered a San Antonio home last week on the East Side, with Homeland Security now saying agents had a warrant, a claim being questioned after video from inside the home surfaced online.

The roughly five-minute video, taken from a live stream on social media, shows tense moments inside the home as family members repeatedly ask agents to show a warrant.

The family says one was never presented.

Homeland Security later confirmed agents were searching for Gonzalo Ortega and said they had a warrant for his arrest. The agency claims Ortega was previously deported to Mexico, illegally re-entered the United States, and has three prior arrests for domestic assault.

News 4 and Fox SA searched Bexar County records but were unable to locate those charges. It is unclear whether the alleged arrests occurred in another state, federal court, or another country.

According to Homeland Security, Ortega escaped by jumping out a window and remains on the run.

As agents attempted to leave the home, video shows a man recording them. Homeland Security claims agents were assaulted. However, the video appears to show the man attempting to close the door before agents turn back and tackle him. The confrontation ended without serious injuries.

The video has raised legal questions about whether agents had a valid warrant and whether it was shown to the family. Rep. Joaquin Castro has since called for an investigation and criticized Gov. Greg Abbott’s handling of immigration enforcement.

Immigration attorney Guillermo Hernandez, who reviewed the video, said a signed judicial warrant is required for agents to lawfully enter a home without consent.

“Unless there’s a valid, executed, signed judicial warrant, you have no obligation to let them into your home,” Hernandez said.

Homeland Security says it is working with the U.S. Attorney’s Office to pursue federal charges against individuals accused of interfering with agents.

We are continuing to seek clarification on whether a warrant existed, why it was not shown, and whether interference charges apply in this case.
