Having your Deed of (Absolute) Sale registered and annotated in the title serves the purpose of protecting your rights and interests as a buyer of a real property, particularly a piece of land.

The Supreme Court has elucidated that:

“The general rule is that a person dealing with registered land is not required to go behind the register to determine the condition of the property. In that case, such person is charged with notice of the burden on the property which is noted on the face of the register or certificate of title.”

The law does not require a person dealing with the owner of registered land to go beyond the certificate of title as he may rely on the notices of the encumbrances on the property annotated on the certificate of title or absence of any annotation.”

The registration and annotation of your Deed of Sale or any form of conveyance on the title with the Register of Deeds and on the owner’s duplicate copy gives you some level of protection against future fraudulent transactions involving the property that you purchased. This includes double and multiple sales. This is especially true when the purchase involves only a portion of a titled property wherein the process of transferring the title may become more tedious because of the requirement of an approved subdivision plan.

In case of a portion of a piece of land, the purchase thereof would require a subdivision plan duly approved by the Land Management Bureau (LMB) of the Department of Environment and Natural Resources (DENR). The process for the transfer of title would be a lot easier if there was already an approved subdivision plan. Otherwise, the time needed as well as the cost of having the lot survey conducted by a licensed geodetic engineer and processed for approval by the DENR would certainly pose a challenge.
