कभी-कभी ऐसी परिस्थितियों का जन्म होता है कि अभियुक्त के पास कोई ज़मानतदार (Surety) नहीं होता है तथा अभियुक्त अकेला पड़ जाता है। ऐसी स्थिति में अभियुक्त को न्यायालय द्वारा जमानत के आदेश दे दिए जाने के उपरांत भी कारागार में रहना होता है क्योंकि अभियुक्त को जितनी राशि के बंधपत्र पर ज़मानतदार (प्रतिभू) सहित पेश करने को कहा जाता है वह पेश नहीं कर पाने में असमर्थ होता है। दूर के स्थानों के रहने वाले या फिर ऐसे व्यक्ति जिनके अपने कोई मित्र और संबंधी ज़मानत नहीं लेते हैं तथा प्रकरण में प्रतिभू नहीं बनते है, उनके लिए ज़मानतदार प्रस्तुत करना अत्यंत कठिन होता है। भारतीय न्याय व्यवस्था अत्यंत समृद्ध और उदार है। इस विकट परिस्थिति से निपटने हेतु दंड प्रक्रिया संहिता में भी धारा 445 के अंतर्गत स्पष्ट प्रावधान दिए गए हैं।

Section 445 in The Code Of Criminal Procedure, 1973
Deposit instead of recognizance. When any person is required by any Court or officer to execute a bond with or without sureties, such Court or officer may, except in the case of a bond for good behaviour, permit him to deposit a sum of money
or Government promissory notes to such amount as the Court or officer may fix in lieu of executing such bond.
